Terms of Service
The agreement between you and us when you use Portal Scraper. It is a business-to-business service: by creating an account you confirm you are using it for your trade, business or profession.
1. About these terms
Portal Scraper is operated by [company name], a company registered in England and Wales under company number [company number], whose registered office is at [registered office address]. You can contact us at [contact email].
These terms, together with our Acceptable Use Policy and, where it applies, our Data Processing Agreement, form the agreement between us and the business you represent ("you"). Our Privacy Policy explains how we handle personal data. If these documents conflict, the Data Processing Agreement wins on personal data, then these terms.
Portal Scraper is provided only to businesses. If you accept these terms for an organisation, you confirm you have authority to bind it. Consumer protection rules that apply only to consumers, such as the 14-day cooling-off period for online purchases, do not apply.
2. Your account
- You must be at least 18 and give accurate account details, and keep them up to date.
- Each account is for one named person. Do not share sign-in details. You are responsible for activity under your account and must tell us promptly if you suspect unauthorised access.
- If you sign in with Google, Microsoft or Facebook, that provider's terms also apply to the sign-in.
3. Free searches
- Visitors without an account, and accounts without an active subscription, can search and see the first results of each search, as shown on the Planning and Directory pages. Attempting to get around this limit, for example by automated or bulk access, is a breach of these terms.
- There is no free trial. A paid subscription shows every result and includes exports, saved searches, AI features, email, one sending domain and five mailboxes. The included domain and mailboxes are provided once per account and are not renewed by cancelling and subscribing again. Further domains and mailboxes are paid extras.
4. Subscriptions and payment
- Prices are shown on the Subscription page and at checkout, together with how VAT is applied. Payments are taken by our payment provider, Stripe, and you also agree to the terms Stripe presents at checkout.
- The app subscription and each mailbox renew monthly, and each domain renews yearly. Each is billed in advance and renews automatically until you cancel it.
- If a payment fails, access to the paid features may stop until it is paid.
- We may change prices by giving at least 30 days' notice. A change applies from your next renewal after the notice period, and you can cancel before then.
- Fees are non-refundable except where these terms say otherwise or the law requires. Domain registration fees cannot be refunded once the domain is registered.
- If you believe a charge is wrong, contact us before disputing it with your bank so we can try to resolve it.
5. Cancellation and what happens when access ends
- You can cancel any subscription at any time from Manage payments and cancellation on the Subscription page. Cancellation takes effect at the end of the period you have paid for.
- When your paid access ends, your account returns to free searches and new email sending stops. Managed domains and mailboxes are held for one calendar month and then removed. Removal cannot be undone, and mailbox contents and credentials are not recoverable afterwards.
- Domains and mailboxes bought through the service are provided for use within the service. Unless we agree otherwise in writing, we do not promise that a domain can be transferred to you.
- You can ask us to delete your account at any time. Our Privacy Policy explains what we keep afterwards and why.
6. Planning data and other information in the service
- The planning data comes from public planning registers, company websites, Companies House and other public sources, and is collected and processed automatically. It may be incomplete, out of date or wrong, and we do not guarantee its accuracy. Check important facts with the original source.
- Planning documents remain subject to the rights of their authors and the publishing council. Links to original documents are provided for reference; you are responsible for any further use you make of them.
- Contact details found by contact discovery are suggestions produced by automated tools and AI. Verify them, and check you are allowed to use them, before contacting anyone.
7. AI features
Some features use AI models to filter, summarise and extract information. AI output can be inaccurate or incomplete and is not professional, legal or planning advice. Each person has a monthly AI allowance; we may refuse requests that would exceed it. Do not enter information into AI features that you are not entitled to share.
8. Your responsibilities for outreach and personal data
- You decide who you contact and what you send. You are responsible for your campaigns complying with data protection law (including the UK GDPR and the Data Protection Act 2018), the Privacy and Electronic Communications Regulations 2003, and any other law that applies, as well as our Acceptable Use Policy.
- When you use or export contact details from the service for your own purposes, you do so as an independent controller of that data and must have your own lawful basis and give any required notices.
- For personal data you upload or that we process on your instructions, such as your company lists, email content and recipients, the Data Processing Agreement applies.
- We may block, delay or cancel messages, or suppress recipients, where we reasonably believe sending would be unlawful, would breach these terms or would harm deliverability for other customers.
9. Email sending, domains and mailboxes
- We do not guarantee that messages will be delivered, reach an inbox or receive replies.
- New mailboxes go through a warm-up period before full sending, and daily sending limits apply. We may pause sending from a mailbox or domain with high bounce or complaint rates.
- If you connect your own email provider account, such as Instantly, you remain responsible for that account and its provider's terms.
10. Your content
You keep ownership of the content you add, such as templates, uploaded lists and messages. You give us a licence to host, copy and process it only as needed to provide and support the service. You confirm you have the rights needed to upload it and that it does not infringe anyone else's rights.
11. Our rights in the service
We own the service, its software and the database we compile, including database rights. While your access is active we give you a non-exclusive, non-transferable right to use the service and its outputs, including exports, for your internal business purposes. You may not resell, sublicense or publish the data as a dataset, or use it to build a competing product.
12. Acceptable use
You must follow our Acceptable Use Policy. In particular, do not scrape or automate access to the service, reverse engineer it, test its security without written permission, or interfere with other customers' use of it.
13. Availability and changes to the service
We aim to keep the service available but do not guarantee it will be uninterrupted or error free, and we may carry out maintenance. We may change, add or remove features. If a change materially reduces what you have paid for, you may cancel and we will refund any prepaid fees for the unused period.
14. Suspension and termination
- We may suspend or end your access immediately if you materially breach these terms, fail to pay, or use the service in a way that exposes us or others to legal risk or harm. Where practical we will warn you first.
- We may also end the service for any other reason by giving you at least 30 days' notice, and will refund any prepaid fees for the period after it ends.
- Sections 6, 8, 11, 15, 16, 18 and 19 continue after the agreement ends.
15. Our liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
- Subject to that, we are not liable for loss of profit, revenue, business, contracts, goodwill or anticipated savings, for loss or corruption of data (beyond restoring it from our most recent backup), or for any indirect or consequential loss.
- Subject to the first point, our total liability under or in connection with this agreement in any 12-month period is limited to the greater of £100 and the fees you paid us in the 12 months before the event giving rise to the claim.
- Except as set out in these terms, all warranties and conditions implied by law are excluded to the extent the law allows.
16. Your indemnity
You will indemnify us against claims, fines and reasonable costs arising from messages you send, or data you upload, export or use, in breach of these terms or the law.
17. Changes to these terms
We may update these terms. For material changes we will give you at least 30 days' notice by email or in the app. If you do not agree, you can cancel before the change takes effect; continuing to use the service after that date means you accept the updated terms. The date at the top shows when they last changed.
18. General
- Neither of us is liable for delays or failures caused by events beyond our reasonable control.
- You may not transfer this agreement without our consent. We may transfer it to a successor of our business.
- This agreement is the entire agreement between us about its subject matter. Nobody else has rights under it under the Contracts (Rights of Third Parties) Act 1999.
- If a court finds part of these terms unenforceable, the rest continues to apply. Not enforcing a right straight away does not waive it.
- We send notices to the email address on your account. Send notices to us at [contact email].
19. Governing law
This agreement and any dispute arising from it, including non-contractual disputes, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
